Real estate transactions support

A real estate lawyer earns their fee before you put down any money: checking the property, the seller and the contract, and working out the taxes. We support buying, selling and leasing property in Ukraine for companies, private buyers and foreign investors.

Our team is based in Kyiv, works across Ukraine with partner notaries, and handles deals remotely for clients abroad.

What our real estate lawyers handle

We support purchases, sales and leases of residential and commercial property, for businesses and individuals alike.

Buying from abroad

Foreigners can buy apartments, houses and commercial property in Ukraine. We get your tax ID number, arrange translations and a power of attorney, and close the deal while you stay home.

Apartments and houses

We check the property’s history and the seller’s right to sell, draft the contract and see the deal through to registration.

Commercial property

Offices, warehouses and retail space: we check permitted use, the land under the building and the tax impact for your company.

Business leases

We draft or review lease agreements: rent and indexation, repairs, utilities and early exit terms.

Property due diligence before you sign

Due diligence comes before any down payment, so you learn about liens, mortgages or co-owners while your money is still in your account. Here is what we check.

Title

An extract from the State Register of Property Rights, title documents and the chain of previous owners.

Encumbrances

Seizures, mortgages, bans on sale, tax liens and court disputes over the property.

The seller

Whether they can sell: spousal consent, children’s shares, powers of attorney and the seller’s debts.

Building and land

Technical passport, unauthorized alterations, commissioning of new builds and rights to the land plot.

Contracts and notaries

In Ukraine, a sale contract is certified by a notary. We work with trusted partner notaries or with the notary you choose. We also negotiate the terms that protect you: price and payment, handover date, who pays which taxes and what happens if the deal falls through. A lease of a building or premises for three years or more must also be notarized under the Civil Code.

If you only need a contract drafted or reviewed, see our document analysis and drafting service.

Taxes on buying and selling property

Having an accountant next to the lawyer pays off most here: we calculate taxes before you sign, not after.

Individual sellers

Pay personal income tax and military levy. One sale per year of a home owned for more than three years is exempt from income tax. Non-residents pay a higher rate.

Buyers

Usually pay a state pension insurance levy unless an exemption applies. The notary certifies the contract only once the seller’s tax is paid.

Companies

A deal also affects the books: VAT, depreciation and corporate income tax. Our accountants calculate the impact and record the deal properly.

Our team speaks English, so you get explanations and documents you can follow. See also our bookkeeping and accounting service for companies that own property in Ukraine.

How real estate transaction support works

1

Request

Tell us about the property, the parties and your timeline.

2

Checks and numbers

We review the property, the seller and the taxes, and quote our fee upfront.

3

Contract

We agree the terms with the other side and the notary.

4

Closing

Signing, payment and registration of your rights, remotely if needed.

What affects the cost

The fee depends on the property type, how complex its history is, whether a foreign party and translations are involved, and whether you need a check, a contract or full support through registration. Notary fees, taxes and levies are paid separately. We quote the price after a first look at the documents, before any work starts. For contracts, disputes and trademarks, see our legal services for business.

Frequently asked questions

Can a foreigner buy property in Ukraine?

Yes. Foreigners can buy apartments, houses and commercial property; restrictions apply to agricultural land. You need a Ukrainian tax ID number and translated documents, and payment goes through a bank. We handle the whole deal remotely under a power of attorney.

Why do I need a real estate lawyer if a notary certifies the deal?

The notary checks documents within their duties and certifies the contract, but does not represent your interests. A lawyer works for you: finds risks before any money changes hands, negotiates terms, builds protection into the contract and calculates the taxes.

What is the difference between an advance and a deposit?

An advance is returned if the deal does not happen. A deposit works differently: if the buyer walks away, they lose it; if the seller does, they pay back double. A deposit gives stronger protection but must be drafted properly, and we advise which suits your deal.

Do you review commercial lease agreements?

Yes. We draft or review leases of offices, warehouses and retail space for businesses. We check the rent and indexation, who pays for repairs and utilities, the security deposit and early exit terms. Our accountants also show how the rent payments will affect your company’s taxes and books.
