Tax audit in Ukraine: what to do first

✓

Check the inspectors’ papers. For an on-site audit, they must show a referral, a copy of the order and service IDs, or they cannot start.

✓

Read the order. It must state the grounds, period and duration; errors can be grounds to challenge the audit.

✓

Note the deadlines. You have 15 working days to answer a written request from the State Tax Service (STS).

✓

Don’t rush to sign. Inspectors may take certified copies, not originals; show any written explanation to your advisor first.

When you need tax audit support

An STS request arrives

We draft the response. An unanswered request can trigger an unscheduled audit.

A scheduled audit is announced

The STS must notify you at least 10 calendar days ahead: enough time to review your books.

An unscheduled audit starts

Typical triggers: an unanswered request, a VAT refund claim, or closing a business.

You receive an audit report

We draft objections. You have 10 working days, so act quickly.

What tax audit support includes

Before the audit

We review the order and deadlines and check your books for the audited period.

During the audit

We prepare answers to inspectors’ requests and keep the audit within the scope of the order. On request, when needed, our specialist attends the inspection.

After the audit

We draft objections and appeals; if needed, our lawyers prepare a court position.

After the report: objections and appeals

An audit report is not yet an assessment: the STS issues a tax notice-decision (the formal assessment) later, and you can object before then.

1

Objections to the report

File them within 10 working days of receiving the report.

2

Administrative appeal

Appeal to the higher-level STS office within 10 working days of receiving the tax notice-decision.

3

Court

Our lawyers prepare the case, and partner attorneys represent you. See business dispute resolution.

Under martial law there is another option. Pay the tax assessed after a documentary audit within 30 calendar days of the tax notice-decision, and the fines are canceled with no late-payment interest. For small amounts, this can beat a dispute.

Frequently asked questions

What should I do if a tax inspection starts without notice?

It is most likely an unscheduled or field inspection, which come without advance notice. Ask for the referral, a copy of the order and the inspectors’ IDs. Do not sign anything in a hurry. Send us photos of the papers and we will advise.

How long does a tax audit in Ukraine take?

It depends on the type of audit and the size of the business. The duration is stated in the order and can be extended only within Tax Code limits. For example, an unscheduled on-site audit lasts up to 5 working days for a small business. For a large taxpayer it is up to 15, for others up to 10.

Will your specialist attend the inspection?

On request, when needed, yes. We agree on the format at the start, depending on the type of inspection. Documents, responses and objections are prepared remotely, so your location in Ukraine does not matter. On-site attendance is discussed once we see the order.

Can I challenge the audit report?

Yes, in three stages: objections within 10 working days, an appeal to the higher-level STS office within 10 working days of the tax notice-decision, then court. We prepare the documents at every stage and work with partner attorneys in court.

Do you support audits if another firm keeps our books?

Yes. We take one-off tax audit support for companies that are not our bookkeeping clients. We will ask for documents for the audited period and quote a fee before starting. Your accountant stays involved: we work alongside them, not instead of them.
