Settling out of court: demand letters and negotiation

Most disputes are cheaper and faster to settle before court, so we start there.

Demand letter

We calculate the claim and send it in a way that proves delivery, such as registered mail with an inventory.

Negotiation

We handle correspondence and meetings with the other side and propose installments, offsets or a repayment schedule.

Settlement agreement

We put the deal in writing: amounts, deadlines and what happens if the other side breaks it.

To prevent the next dispute, see our contract drafting and review service.

Debt recovery

Debt recovery depends on evidence, not on who is right. Ukrainian courts rely heavily on primary documents, which is where having an accountant on the team pays off.

What we check

  • ✓the contract and payment terms
  • ✓invoices and signed acceptance certificates
  • ✓payments and reconciliation statements

What we calculate

  • ✓the principal debt
  • ✓contractual penalties
  • ✓inflation losses and 3% annual interest
  • ✓the limitation period

We spot gaps such as unsigned certificates early, while the debtor can still sign a reconciliation statement.

Disputes we handle

Commercial disputes

Unpaid invoices, short deliveries, poor-quality work and advance refunds.

Tax disputes

Objections to a tax audit report, administrative appeals of tax assessments and court. Our accountants know your books, so arguments rest on your own records.

Employment disputes

Dismissals, unpaid salaries and employee claims.

Corporate disputes

Conflicts between LLC members: exits, ownership shares and challenges to shareholder decisions.

Going to court with partner attorneys

If negotiation fails, a partner attorney represents you in court, while our lawyers build the case. We never promise a win, since the court decides, but we honestly assess your chances and costs before you file.

How we work

1

You share the facts

Send the contract, invoices and correspondence.

2

We assess the case

A lawyer and an accountant review documents, claims and deadlines.

3

You get a plan and a quote

We suggest the route and name the fee before work starts.

4

We act

We send the demand, negotiate and, if needed, prepare the case for the partner attorney.

We work remotely under a power of attorney and are insured for professional liability. For ongoing needs, see legal support for your business.

What affects the cost

The fee depends on the stage (demand letter, negotiation or court preparation), the type of dispute and the volume of documents. We quote after assessing your documents, before work starts. Court fees are paid separately.

If a tax audit is still underway, start with our tax audit support. All other areas are listed under legal services for business.

FAQ

Do I have to send a demand letter before going to court?

Not always. Most often the contract itself requires one, and then the court will check that you followed that pre-trial procedure. Otherwise you can file directly, but a demand letter often gets you paid faster.

How long do I have to file a claim in Ukraine?

The general limitation period is three years, and one year for contractual penalties. It runs from when you learned, or should have learned, of the breach. If the debtor acknowledges the debt, for example by signing a reconciliation statement, the period restarts. Martial law no longer pauses it, so check the deadline for older debts with a lawyer as soon as possible.

Can you represent us in court?

Yes, we do, through partner attorneys. Our lawyers prepare the legal position, documents and evidence, and our accountants check the figures. A partner attorney then represents you at hearings, with the case already prepared and your accounting records behind it.

How do we challenge a tax assessment?

First, file objections to the audit report within 10 working days of receiving it. Then appeal the tax assessment to a higher tax authority, also within 10 working days, or go to an administrative court. These deadlines still run while martial law is in effect. During the administrative appeal, the assessed amount is not yet final.

How much does dispute support cost?

It depends on the stage, the type and complexity of the dispute and the volume of documents. We name the fee after reviewing your case, before work starts. Court fees are separate and depend on the claim amount. We can’t promise an outcome, but we’ll tell you honestly if the case is worth pursuing.

Business dispute resolution in Ukraine starts with your documents

Send us the contract and correspondence, and we’ll tell you if court is worth it and quote the fee upfront.
